Lasting Powers of Attorney

Lasting Powers of Attorney (LPAs): Protecting your future decision-making
A Lasting Power of Attorney (LPA) allows you to choose trusted people to make decisions on your behalf if you are ever unable to do so yourself. Putting LPAs in place now gives you certainty, control, and peace of mind for the future.
At Morgan Kelly, we provide clear, practical legal advice and handle the entire process for you — from initial discussion through to registration — ensuring your LPAs accurately reflect your wishes and are legally robust.

What is a Lasting Power of Attorney?
There are two types of LPA:
- Property and Financial Affairs LPA
Allows your attorney(s) to manage matters such as bank accounts, investments, property, and bills.
- Health and Welfare LPA
Covers decisions about medical treatment, care arrangements, and living arrangements if you lose capacity.
You can make one or both, and you remain fully in control while you have mental capacity.

Our LPA service
We make LPAs in person only – we always meet with our clients, face to face, and take the time to understand your circumstances, family dynamics, and concerns. We tailor your LPAs accordingly.
Our service typically includes:
- A detailed discussion to explain your options in plain English
- Advice on choosing appropriate attorneys and replacement attorneys
- Guidance on safeguards, restrictions, and preferences
- Drafting the LPAs to reflect your instructions precisely
- Acting as Certificate Provider
- Managing execution and witnessing
- Submitting the LPAs for registration with the Office of the Public Guardian
- Providing Certified Copies of the documents
We ensure the documents are completed correctly first time, reducing the risk of delays or rejection.

When should I make an LPA?
An LPA can only be made while you have mental capacity, so it is sensible to put arrangements in place sooner rather than later — regardless of age or health.
Many clients choose to make LPAs:
- When reviewing their Will
- When buying or selling a property
- After a major life change
- Following a diagnosis or health concern
- As part of general future planning

Why use a solicitor rather than an online service?
While LPAs can be created online – and we absolutely recommend you try this before appointing a solicitor. However, please be aware that problems sometimes only become apparent after capacity is lost, when it is too late to correct them.
By instructing a solicitor, you benefit from:
- Proper legal advice tailored to your situation
- Protection against drafting errors or unintended consequences
- Consideration of future risks such as family disputes or financial vulnerability
- A firm that already understands your wider legal affairs
Our role is not just to complete forms, but to protect you and your family.
